Environmental Compliance

Our compliance specialists work closely with clients to develop a tailored compliance strategy to meet the needs of the client and their operations.

Compliance Management Plans (“CMPs”)

CMPs are unique to each project, depending on the needs of the client and the project at hand.  With this in mind, TerraWest typically initiates compliance planning services with a general facility audit or inspection.  Our compliance specialists review facility operations permits, plans, manifests, process documents, and the facility notification status.

Following the initial audit or inspection, a detailed site inspection is performed.  During the site inspection, we evaluate compliance pursuant to:

  • The Superfund Amendments and Reauthorization Act (“SARA”)
  • The Resource Conservation and Recovery Act (“RCRA”)
  • The Clean Air Act (“CAA”)
  • The Comprehensive Environmental Response, Compensation, and Liability Act (“CERCLA”)
  • The Clean Water Act (“CWA”)
  • The Toxic Substance Control Act (“TSCA”)
  • DOT regulations
  • OSHA regulations

All compliance inspections are summarized in a facility inspection report which provides a detailed accounting of individual compliance issues discovered during inspections. Our inspection reports are designed to be informative and accessible. All observations are accompanied by detailed explanations of compliance issues, possible regulatory citations, and our recommended solutions. After audit completion, Terrawest assists in the implementation of procedures, process changes, and strategies designed to achieve compliance with the required environmental and OSHA regulations. We prioritize which violations need immediate attention, versus, those that are less likely to result in adverse safety conditions or incur regulatory fines. Our goal is to work together and develop a long-term strategy for full compliance.

National Pollutant Discharge Elimination System (NPDES) Permitting

TerraWest Consulting offers inspection services to ensure compliance with federal and state regulations regarding point source discharges of pollutants. This includes the NPDES, as well as state-specific regulations.

When land disturbance begins, our NPDES Inspections regularly assess the condition of structural onsite controls, such as silt fencing, inlet protection, sediment basin function, etc., as well as non-structural controls such as hazardous materials housekeeping, training of personnel, placement of portable toilets, and the stabilization of disturbed areas, etc.  Our team of Erosion and Sediment (E&S) control/NPDES inspectors has established a distinguished role above other inspection providers through sincere dedication to a higher level of oversight.

Phase I Environmental Site Assessments (ESA)

TerraWest Consulting works on behalf of all parties in real estate transactions, including buyers, sellers, investors, and lenders. Our team follows the industry-recognized ASTM guidelines (i.e., ASTM e1527-13 and the EPA’s All Appropriate Inquiry (“AAI”) standard) to ensure our work meets the highest standards.

Phase II Environmental Site Assessments

The purpose of Phase II Environmental Site Assessment is to determine the presence, likely presence, or absence of substances (constituents of concern) in environmental media, including soil, soil vapor, groundwater, surface water, and indoor air. Phase II’s are typically conducted as a result of Recognized Environmental Conditions identified in a Phase I ESA.

Phase II ESAs assist our clients in evaluating potential environmental risks, health risks, financial risks, and potential liability associated with these risks, based on our clients’ needs and potential uses of the site. Phase II ESA may include some or all of the following services:
